End User License Agreement ("EULA") for AvPro® Software

 

 

Acceptance of Terms

By downloading, installing, or using the AvPro® software (hereinafter referred to as "Software"), you (the "User" or "Licensee") accept the terms of this EULA. If you do not agree to the terms, do not install or use the Software.

 

Grant of License

Subject to this EULA, Decision Software Systems, Inc. (DSS) grants the Licensee a non-exclusive, non-transferable, limited license to install and use the Software for lawful, internal, non-commercial purposes, unless otherwise specified.

 

Restrictions

The Licensee agrees not to:

a) Modify, reverse engineer, decompile, or disassemble the Software.

b) Rent, lease, loan, sell, distribute, or create derivative works of the Software.

c) Use the Software for any commercial purpose without the express written consent of DSS.

 

Intellectual Property Rights

All title, including but not limited to copyrights, in and to the Software and any copies thereof are owned by Decision Software Systems, Inc. All rights not expressly granted herein are reserved by DSS.

 

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from DSS if you fail to comply with any of its terms.

 

Limited Warranty

The Software is provided "AS IS" without warranty of any kind. DSS does not warrant that the Software will meet your requirements or that its operation will be uninterrupted or error-free.

 

Limitation of Liability

In no event shall DSS be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) arising out of the use of or inability to use the Software.

 

Updates

DSS may release updates or new versions of the Software. This EULA applies to all updates unless a new EULA is provided with those updates.

 

Governing Law

This EULA shall be governed by and construed under the laws of the jurisdiction in which the Software was purchased.

 

Entire Agreement

This EULA constitutes the entire agreement between you and Decision Software Systems, Inc. concerning the Software and supersedes all prior or contemporaneous communications.
